المسئولية الجنائية عن العنف والتعصب الرياضي : دراسة في المملكة العربية السعوديةالعصيمي، دلال بنت مرزوق كيمخ; عباس، نهاد فاروق (مشرف).; الرسول، منى حسب (مناقش).; البجاد، محمد بن ناصر (مناقش).مشكلة الدراسة: تكمن مشكلة الدراسة في التساؤل الرئيسي التالي: ما حدود المسؤولية الجنائية عن العنف والتعصب الرياضي في المملكة العربية السعودية؟أهداف الدراسة: هدفت الدراسة إلى التعرف على طبيعة العنف والتعصب الرياضي, والتعرف على أشخاص العنف والتعصب الرياضي, وتحديد عناصر القصد الجنائي في العنف والتعصب الرياضي, والتعرف على العقوبات المترتبة على تحقق المسؤولية الجنائية عن العنف والتعصب الرياضي, وتوضيح التدابير الاحترازية اللازمة للوقاية من العنف والتعصب الرياضي.منهج الدراسة: استخدمت الباحثة المنهج الوصفي بطريقته العلمية التي تجمع بين الطريقتين الاستقرائية والاستنتاجية، واعتمدت على الأدلة الشرعية وأحكامها وعلى الأنظمة واللوائح في النظام السعودي وما تضمنته من قرارات وتعاميم وإجراءات لها صله بالموضوع مع الرجوع إلى المصادر والكتب المعاصرة في هذا المجال والمواثيق الدولية المرتبطة بالموضوع. أهم النتائج:1- أن الفرق بين العنف الرياضي والرياضة العنيفة هو المظهر الخارجي لنشاط اللاعب مرتكب السلوك العنيف والذي يجعله المنظم في إطار الإباحة أوالتجريم وفق الشروط المتخذة، فإنها ضربة قانونية بل إن القانون يؤكد على استعمال هذا الحق بعكس العنف الرياضي الذي يجرم هذه الأفعال وتتمثل في الرياضات التي ليس فيها احتكاك.2- إن من أشخاص العنف الإعلام الذي يمثل وسيلة فعالة في ظهور العنف والتعصب الرياضي وذلك من خلال تناوله لبعض المواضيع بطريقة تثير حفيظة الجماهير، حيث تمارس التضليل وتتلاعب ببعض الألفاظ باستعمال لغة تجعل الرياضة شبيهة بالحرب وإبراز الأعمال المفرطة في العنف والحث على التحيز والتعصب. 3- إن أساس العنف الذي يحدث من اللاعب في الرياضات التي فيها احتكاك مباشر قد يكون بسبب إهمال أو رعونة أو عدم احتراز كاف ويترتب عليه المسؤولية الجنائية.4- يترتب على انتفاء القصد الجنائي لدى الجاني مرتكب العنف الرياضي عدم جواز مساءلته عن الجريمة ولكن ذلك لا يعني عدم جواز إلزامه بالتدابير الاحترازية.أهم التوصيات:1- زيادة الثقافة والوعي الرياضي توصلا لحقيقة أن الرياضة عموماً لم توجد من أجل التعصب, وإنما من أجل الفائدة وقضاء الأوقات واستثمارها فيما يفيد النفس والروح والمساعدة على تهذيبها.2- تبني النقد الهادف, ومنع المتعصبين من تبادل الشتائم عبر القنوات الإعلامية المختلفة, وتوجيههم إلى خدمة النادي الذي يشجعونه بدلا من الدفاع عنه بالحق وبالباطل.3- اختيار المعلقين الذين يتحلون بروح المسؤولية الرياضية وعدم التحيز.4- تطوير لائحة الانضباط للاتحاد العربي السعودي لكرة القدم لعام 1433هـ والتي تعد مساهمه فعاله في سبيل الحد من ظاهرة العنف الرياضي.; Study Title: the criminal responsibility on sportive violence and enthusiasm: a study in the kingdom of Saudi Arabia Student: Dalal Marzouq AlausaimiAdvisor: DR. Nehad Farouk AbbasResearch problem: The study problem is represented in the following main question: What are the limits of criminal justice on sportive violence and enthusiasm: a study in the kingdom of Saudi Arabia? Study objectives: The study aimed at identifying the sportive violence and enthusiasm, and clarifying the limits of sportive violence and enthusiasm, in addition to identifying the appearances on which the criminal responsibility is based on it in the field of sportive violence and enthusiasm, and specifying what is arranged to the criminal responsibility on those who practice sportive violence and enthusiasm in the kingdom of Saudi Arabia. Research methodology: The researcher sued the descriptive approach in their scientific ways which gather between the induction and concussion methods, the study depends on Islamic evidences, provisions, systems and regulations in the Saudi regime and which included such as decisions, annunciations and procedures related to the subject with reference to sources and contemporary books in this field and international charters related to the subject.Main results: 1- Practicing sport is a permissible thing as a base but this permissible is not absolute but it has conditions and regulations which must be respected and noticed, these regulations in conclusion care for the fifth Islamic necessities. 2- Media in the sport population is an effective method in the appearance of sportive violence and enthusiasm through discussing some subjects in a way which exhaust audiences, whereas the misinformation and wordplay are used by using language which makes sport like a war by appearing the excessive doings in violence and exhausting on prejudice and intolerance.3- The player acceptance to the game risks must not be out of its known limits and rules and any assault occurs when playing under the coverage of game must not be accepted and should be considered as willful abuse.4- In case of there is no Criminal Intent of the criminal of sportive violence, he should not be required for accountancy on the crime but he is will be requested for precautionary actions. Main Recommendations: 1- Sportive culture and awareness because that the sport reality in general has not found for enthusiasm, but for benefit, spending times and investment in what is benefit for soul and spirit to help in refinement.2- Adopting the positive criticism and preventing fanatics from meetings on media and channels and guiding them for the service of their club instead of defense whether on right and wrong.3- Choosing sport commentators who has sportive responsibility sprit and impartiality.4- Developing the regulation of commitment of Saudi Arabian union for football for 1433H which is an effective participation in order to reduce the sportive violence phenomenon.131 ورقة :; أطروحة (ماجستير)--جامعة نايف العربية للعلوم الأمنية، كلية العدالة الجنائية، قسم الشريعة والقانون، 2015.; ببليوجرافية : ص. 118-131.
