نموذج اولى من عقد العمل
انه في يوم ( ) بتاريخ / / 1432 هـ والموافق / / 2011 م قد تم إبرام عقد العمل بين مكتب ------------------------------- فيما يلي بالطرف الأول ويمثله المهندس / --------------------------- .
والسيد / ----------------------------- --------------------- ---------------- الجنسية وحامل للجواز رقم ---------------- والمسمي فيما يلي بالطرف الثاني.
وقد إتفق الطرفان وهما بأتم الأوصاف المعتبرة شرعاً علي ما يلي :-
يعين الطرف الثاني للعمل بمهنة -------------- براتب شهري وقدرة -------------------------------------------------------------------------------- تحسم منه رسوم التأمينات الإجتماعية المقررة حسب القوانين السعودية وأية رسوم أو ضرائب مستحدثة.
يعطي الطرف الثاني البدلات الشهرية التالية :
أ) بدل إضافي قدرة -----------------------------
ب) بدل طعام قدرة -------------------------------
ت) بدل سكن وقدرة --------------------------------------------------------------------------- أو يؤمن له سكن أعزب / متزوج.
ث) المواصلات : بدل مواصلات وقدرة ---------------------------------------------------------
أو سيارة / وسيلة نقل بين السكن والعمل.
ج) يعطى الطرف الثاني تأمين صحي طبقا للأنظمة .
يعطي الراتب الشهري المذكور أعلاه مقابل ثمان ساعات عمل يومياً لمدة ستة أيام اسبوعياً ويدفع حسب التقويم الميلادي
يحق للطرف الأول إستقطاع نسبة ----- بالمائة من الراتب الشهري للطرف الثاني حتي ما مجموعة الإجمالي ----------------- ريال سعودي وذلك لحساب صندوق التوفير يعاد دفعة للطرف الثاني في حال إتمامة العقد أو في حال إستغناء الطرف الأول عن خدماته.
مدة العقد ------------- تبدأ من تاريخ بدء عمل الطرف الثاني بالعمل ويعتبر العقد مجدداً تلقائياً ما لم ينذر أحد الطرفين الطرف الأخر خطياً قبل شهر على الأقل بعدم رغبتة في تجديد العقد.
يخضع الطرف الثاني لفترة تجربه مدتها ثلاثة شهور فإن لم يقم بالعمل المنط به قياماً مرضياً فللطرف الاول الحق والصلاحية في انهاء العقد خدمته دون اشعرة بفترة إنذار كما يحق للطرف الثاني إنهاء العقد خلال هذه الفترة دون إشعار الطرف الأول بفترة إنذار
This EMPLOYMENT, is made between ------------------------------ represented by Eng. ------------------------------
hereinafter referred to as the frits party.
And Mr. -------------------------------------------------------- of---------------------------------- nationality and holding passport No.-------------------------
hereinafter referred to as the second party.
Both parties legally agreed upon the flowing:
The first party hereby employs the second party as ----------------------- at a monthly salary of S.R.-------------------------------- subject to the deduction of social insurance premiums imposed under the Saudi law or any or other taxes to be introduced, subsequently. The second part will be given the flowing monthly allowances:
Over time all: S.R.----------------------------
Food all: S.R. --------------------------------
Housing allowance : S.R----------------------------------------------------------------------or provide bachelor / family accommodation.
Transportation : allowance: S.R -------------------------------------------------------------
Or provide a car / transportation means.
the monthly salary shall be give for eight working hours /day, six-days work a week, and shall be paid according to Gregorian calendar.
The second part authorizes the first party to deduct --------------- percent of this monthly salary up to the total amount of S.R. ------------ for saving fund to cover expatriation and repatriation expenses should he be repatriated for violation of this Employment contract. This saving shall be reimbursed to the second party if he completed the duration of this contract
Or if he was terminated by the first party.
The duration of this contract is ------------ years effective the date the second party commences work at jobsite automatically renewed unless one party served one month written notice to the other party.
علي أن يتحمل الطرف الثاني في هذه الحالة كافة مصاريف توظيفة ومصاريف سفرة إياباً وذهاباً.
مكان العمل يقصد به أي مكان في المملكة العربية السعودية.
يتعهد الطرف الثاني بالتقيد التام بقوانين المملكة والإمتناع عن القيام باي نشاط سياي أو أي عمل يتنافي مع الإنظمة والإجراءات المعمول بها في المملكة. وإلا وقع تحت طائلة فسخ العقد وصرفه دون سابق إنذار ودون أي تعويض أومكافأة.
لا يحق للطرف الثاني طوال مدة هذا العقد أن يعمل لدي أي شركة أخري أو يتعاطي أي عمل آخر بأجر اوبدون أجر
يخضع راتب الطرف الثاني إلى زيادة سنوية بناء على التقييم الحاصل عليه خلال عمله .
في حال الإستقدام من الخارج يمنح الطرف الاول للطرف الثاني تذكرة سفر إقتصادية من --------------- الي المملكة العربية السعودية.وفي حال عدم إستطاعة الطرف الأول الحصول علي تأشيرة عمل للطرف الثاني فيعتبر هذا العقد ملغياً.
إذا رغب الطرف الثاني في فسخ العقد قبل نهايتة بدون سبب مشروع فتقع عليه مسئولية إشعار الطرف الأول خطياً قبل شهرين علي الاقل وإذا فشل في إشعار الطرف الأول عليه أن يدفعه له تعويضاً يعادل أجرة لمدة شهرين وفي كلتا الحالتين يتحمل الطرف الثاني نفقات العودة إلى بلده.
تسري أحكام نظام العمل والعمال ونظام التأمينات الإجتماعية على كل ما لم يرد بشأنه نص في هذا العقد وهو خاضع في تطبيقة وتفسيرة للأنظمة المعمول بها في المملكة العربية السعودية ويعتمد النص العربي كأساس في حال حصول أي خلاف بين الطرفين حول تفسي هذا العقد.
ابرم العقد في -------------------------------------وحرر من نسختين أصليتين متطابقتين أحتفظ كل طرف بأحاهما بعد التوقيع عليها من قبلهما.

The site of employment shall be anywhere in KSA.
The second party undertakes to comply with all the regulations and customs prevailing in Saudi Arabia and refrain from any political activities violation of this article will lead to termination of contract without notice or compensations, and proper sanctions will be applied.
The second part during this contract period is not allowed to work for anybody else, with or without payment.
In case of foreign employment, the first party shall provide the second party an economy ticket from ---------------------- to KSA. If the first party fails to obtain a work visa to the second party this contract will be invalid.
The second party shall earn annual paid leave at the rate of ------------------------ Days / year
The first party shall provide the second party free return economy excursion ticket -------------------- upon completion of the term of this contract.
The second party may terminate the contract by serving a tow months written notice to the first party if he failed to serve such a notice, he has to pay the first party an equivalent of tow month salary as compensation in both cases, the second party has to shoulder the cost of ticket to his country of origin.
The first party ,has the right to terminate this contract without any notice or compensation if the second party fails to fulfill his obligations under this contract or if he commits an act whereas application of artical83. Of labor law becomes imperative. In such case, second party shall his repatriation expenses.
This contract is subject to Saudi Arabia labor law and social insurance scheme the execution and interpretation of this contract will be according to Saudi law. The Arabic version will prevail in case of any interpretation.
This contract has been prepared and signed on ------------------------------------------------------------------------------------------ in duplicate each party having a copy for his own reference and record.
