حقوق المرأة والطفل في نظام التنفيذ السعودي : دراسة تأصيلية تطبيقية عوشن، يعقوب بن سعد محمد بن مشكلة الدراسة : ما هي حقوق المرأة والطفل الواردة في نظام التنفيذ السعودي. منهج الدراسة : اتبعت هذه الدراسة المنهج الوصفي . أهداف الدراسة : بيان حقوق المرأة والطفل المادية والمعنوية في الشريعة الإسلامية ، وبيان امتيازات وحقوق المرأة والطفل في الأحوال الشخصية وفي تنفيذ الأحكام المالية ، وتوضيح أنواع القرارات والأوراق التي تصدرها محاكم التنفيذ . أهم نتائج الدراسة : راعى نظام التنفيذ المرأة والطفل في مكان رفع الدعوى لطالب التنفيذ وذلك بأن يكون في بلد المرأة أو الطفل ، واستثنى النظام المرأة الحامل أو من لديها طفل لم يتجاوز الثانية من عمره من تنفيذ الحكم بالحبس عليها إذا كانت مدينه، كما أنه لا يجوز الحجر والتنفيذ على الدار التي يسكنها المدين أو من يعولهم شرعاً ، وتقدم النفقة للزوجة والأطفال على جميع الديون إذا كانت حالة . أهم توصيات الدراسة : أوصي لجميع المختصين بإقامة الندوات والدورات التدريبية للتعريف بحقوق المرأة والطفل في نظام التنفيذ ، كما أوصي بأن يخصص دوائر للتنفيذ في الأحوال الشخصية مستقلة تماماً ، وذلك أسوة بدوائر الأحوال الشخصية في المحاكم العامة ، وإعداد دور وأماكن مهيأة لاستقبال قضايا الزيارة والحضانة.; Study Title: Woman's and child's rights in Saudi executive system authentication applied study. Student: Yaqoub Bin Saad Mohammed Bin Awshan Advisor: Eyad Ahmed Ibrahim Research Problem: What are the rights of woman and child that mentioned in Saudi executive system? Research Methodology and tools: The study has followed descriptive methodology. Study Objectives: stating the materialistic and morale rights of woman and child in Islamic Shariah, showing the privileges and rights of woman and child in personal status and in implementation of financial judgments, and explanation of decisions and documents types that issued by execution courts. Main Results: The execution system took care of woman and child in place of suit for execution claimant that to be in woman's or child's country, the system has exempted the pregnant woman or who has a child not exceeding two years old from implementation of the judgment by jailing if she is debited, also it is not permissible to isolate and execute on the home in which the debited person or who is legally sponsoring them is resided, the expenditure is to be paid to the wife and children on all debts if it is a case.
