حجية الآثار المادية للأسلحة النارية في الإثبات الجنائي بين الشريعة والقانونالعتيبي، عيد بن رهيدل مشرع المغيريمشكلة الدراسة: صاغ الطالب مشكلة دراسته في التساؤل التالي: ما حجية الآثار المادية للأسلحة النارية في الإثبات الجنائي. أهداف الدراسة: هدفت الدراسة إلى التوصل إلى: التعريف بالأسلحة النارية، وتوضيح أنواع آثار الأسلحة النارية، وتبيان وسائل فحص آثار الأسلحة النارية، وتحديد دلالات الآثار المتخلفة عن الأسلحة النارية، والتعريف بحجية آثار الأسلحة النارية. منهج الدراسة: المنهج الوصفي التحليلي بطريقتيه الاستقرائية والاستنتاجية للنصوص المتصلة بموضوع الدراسة. أهــــم النتائج : 1ـ الآثار المادية للأسلحة النارية هي الهدف الأساسي الذي يدور حوله عمل فريق التحقيق لأنه هو الذي يحدد شخصية الجاني. 2ـ أن الآثار المادية للأسلحة النارية تظهر على جسم الرامي وعلى الهدف أيضاً. 3ـ أن الآثار المادية للأسلحة النارية تتمثل في المقذوف ـ الظرف ـ الكبسولة. 4ـ أن تقرير الخبير المبني على الفحص المعملي للآثار المادية يقدم كشهادة في الإثبات الجنائي، ويؤخذ بهذه الشهادات في النظام السعودي كقرائن. أهم التوصــيات: أوصت الدراسة بما يلي: 1ـ التوسع في استخدام التقنيات الحديثة في فحص الآثار المادية للأسلحة النارية. 2ـ إعادة النظر في موقف القضاء من حجية الآثار المادية للأسلحة النارية. 3ـ عقد دورات تدريبية للقضاة والمحققين في أساليب فحص الآثار المادية للإحاطة بما يقدم إليهم بشأنها.; Study Title: The proofing of physical effects on the firearms in criminal evidence between Sharia and law,Student: Eed Raihidal Mushre Al OtaibiAdvisor: Dr. Eyad Ahmed Mohamed IbrahimResearch Problem:The study is determined on the reply to the question:What are proofs of the physical effects on the firearms in criminal evidence?Study Objectives:The study aimed to access to: Recognition the firearms and indicates the types of the firearms and indicates the methods of investigation the effects of the firearms.
